TERMS & CONDITIONS, ASSUMPTION OF RISK & LIABILITY WAIVER

By booking, entering, or using the facilities at Pin High PGH LLC (“Pin High PGH,” “we,” “us,” or “our”), you (“Participant,” “Guest,” or “User”) acknowledge that you have read, understand, and agree to the following Terms & Conditions and Liability Waiver.

1. ASSUMPTION OF RISK

Golf and golf simulation activities involve inherent risks, including but not limited to:

  • Being struck by golf balls, clubs, or equipment

  • Slips, trips, or falls

  • Equipment malfunction

  • Physical injury due to swinging, overuse, or improper form

  • Injuries caused by other participants

You voluntarily assume all risks, known and unknown, associated with participation at Pin High PGH.

2. RELEASE OF LIABILITY

To the fullest extent permitted by Pennsylvania law, you release, waive, and discharge Pin High PGH LLC, its owners, officers, employees, contractors, affiliates, and agents from any and all claims, demands, actions, or causes of action arising out of or related to:

  • Personal injury

  • Property damage

  • Loss, theft, or damage to personal belongings

  • Death

This release applies whether caused by negligence or otherwise, except for willful misconduct or gross negligence where prohibited by law.

3. INDEMNIFICATION

You agree to indemnify and hold harmless Pin High PGH from any claims, damages, losses, or expenses (including attorney’s fees) arising from:

  • Your participation

  • Your guests’ participation

  • Your violation of these Terms

  • Your misuse of equipment or facilities

4. MEDICAL ACKNOWLEDGMENT

You confirm that:

  • You are physically capable of participating

  • You have no medical conditions that would prevent safe participation

  • You understand that Pin High PGH does not provide medical supervision

You agree to assume full responsibility for any medical treatment required as a result of participation.

5. EQUIPMENT USE & CONDUCT RULES

Participants agree to:

  • Follow all posted rules and staff instructions

  • Use equipment only as intended

  • Refrain from reckless, unsafe, or abusive behavior

  • Not swing clubs outside designated hitting areas

  • Keep food, drinks, and non-participants clear of hitting zones

Pin High PGH reserves the right to remove any participant without refund for unsafe or disruptive behavior.

6. DAMAGE TO PROPERTY

You are financially responsible for any damage caused by you or your guests to:

  • Launch monitors

  • Screens

  • Projectors

  • Turf, mats, or enclosures

  • Building fixtures

Pin High PGH may charge the card on file or invoice for repair or replacement costs.

7. ALCOHOL & SUBSTANCE POLICY

If alcohol is permitted:

  • You must be of legal drinking age

  • Intoxicated individuals may be denied access or removed

  • No illegal substances are allowed

Pin High PGH assumes no responsibility for injuries or damages related to alcohol or substance use.

8. BOOKINGS, PAYMENTS & CANCELLATIONS

  • All bookings are subject to availability

  • Cancellations or no-shows may be non-refundable

  • Late arrivals may result in reduced session time without refund

Pin High PGH reserves the right to modify pricing, hours, or availability at any time.

9. MINORS

  • Minors must be supervised by a parent or legal guardian at all times

  • A parent or guardian must accept these Terms on behalf of the minor

  • Pin High PGH reserves the right to restrict access based on age or safety concerns

10. PHOTO & VIDEO RELEASE

You grant Pin High PGH permission to use photographs or video recordings taken on premises for:

  • Marketing

  • Social media

  • Website content

If you do not wish to be recorded, you must notify staff in writing prior to participation.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pin High PGH’s total liability for any claim shall not exceed the amount paid by you for the applicable session.

12. FORCE MAJEURE

Pin High PGH shall not be liable for cancellations or interruptions due to events beyond our control, including but not limited to power outages, equipment failure, weather, or governmental action.

13. GOVERNING LAW & VENUE

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania.
Any legal action shall be brought exclusively in Allegheny County, PA.

14. ACKNOWLEDGMENT & ACCEPTANCE

By booking a session, entering the facility, or using the equipment, you acknowledge that:

  • You have read and understood these Terms

  • You are waiving substantial legal rights

  • You agree voluntarily and without coercion
